Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Tidal Markets (tidal.markets) and any related services, applications, and content (collectively, the “Service”), operated by Tidal Markets (“we,” “us,” or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Not financial advice

The Service provides aggregated options-market data and analytics — including gamma, charm, and vanna exposure (“GEX,” “CEX,” “VEX”), dealer-positioning estimates, and derived levels — for educational and informational purposes only. Nothing on the Service constitutes financial, investment, tax, or legal advice, a recommendation, or a solicitation to buy or sell any security or derivative. We are not a registered investment adviser, broker-dealer, or financial planner. You are solely responsible for your own trading and investment decisions. Options and other derivatives carry a substantial risk of loss and are not suitable for every investor. Past or modeled behavior does not guarantee future results.

2. Data accuracy and availability

Our analytics are derived from third-party market-data sources and computed models. Data may be delayed, incomplete, estimated, or inaccurate, and models rely on assumptions that may not hold. We do not warrant the accuracy, timeliness, completeness, or fitness of any data or analytic for any purpose. The Service is provided on an “as is” and “as available” basis and may be interrupted, delayed, or discontinued at any time without notice.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the security of your account and for all activity under it. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use.

4. Subscriptions, billing, and cancellation

Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on each renewal until you cancel. Prices are shown at checkout and may change with notice; changes apply to subsequent billing periods.

You may cancel at any time from your account’s billing portal. Cancellation stops future renewals; your plan remains active through the end of the current paid period, after which your account reverts to the free tier. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.

5. Acceptable use

You agree not to: (a) resell, redistribute, scrape, or republish the Service’s data or analytics except as expressly permitted; (b) reverse engineer or attempt to extract source code or underlying data feeds; (c) circumvent access controls or tier restrictions; (d) use the Service to violate any law or third-party right; or (e) interfere with or overload the Service’s infrastructure.

6. Intellectual property

The Service, including its software, design, analytics, and content, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes, subject to these Terms.

7. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY TRADING OR INVESTMENT LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

10. Changes and termination

We may modify these Terms or the Service at any time. Material changes will be reflected by updating the effective date above; continued use after changes constitutes acceptance. We may suspend or terminate access for any violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules.
